JAMMU, Oct 10: BJP MLC, Girdhari Lal Raina has sought immediate intervention of Divisional Commissioner, Kashmir Bashir Ahmed Khan in removing encroachments from migrants’ land and religious places in Valley.
In this regard Raina has written a letter to Khan. In his letter, Raina said that he has received a large number of complaints about the illegal encroachment of immovable properties of the displaced community members living in exile outside the Valley. The letter said that the properties both belonging to individual migrants and also community as a whole in the form of shrines, temples, institutions and cremation grounds have been encroached. Similarly the unauthorized occupants included individuals, groups of individuals in the form of an organised syndicate and in several cases even public authorities, the letter added.
Drawing attention of the Divisional Commissioner, about Section 3 of the J&K Migrant Immovable Property (Preservation, Protection and Restraint on the Distress Sales) Act, 1997 that restricts alienation of immovable property belonging to migrants and also the Section 4 titled custody of immovable property, Raina urged the Revenue authorities to implement the same in letter and spirit.
The letter said that under the Act within 30 days from time of commencement of this Act, the District Magistrate shall take over jurisdiction of immovable property, belonging to migrants, falling under his territorial jurisdiction and shall on the expiry of said period of 30 days , be deemed to have the custody of such immovable property.
The Act also states that District Administration should take all such steps as may be necessary for the preservation and protection of the migrant property.
Raina has urged the Divisional Commissioner, Kashmir that the Revenue authorities should provide the list of properties identified in Kashmir Division under the jurisdiction of Divisional Commissioner, the steps taken by the Government for preservation and protection of migrant property, the complaints received from migrants about illegal encroachment of their property and action taken to redress the grievances of these complaints.
