Bail rejected in house breaking, theft case

JAMMU, Jan 11: JMIC Bishnah Ananta Raina has rejected the bail application of three accused involved in house breaking and theft case.
As per reports, JMIC Bishnah Ananta Raina has rejected the bail application of three accused namely Vijay Kumar, son of Kartar Chand, Sandeep Singh, son of Ashok Singh and Sunil Kumar, son of Krishan Lal involved in a case registered under FIR Number 184/2020 under Sections 457 and 380 IPC with Police Station Bishnah.
Advocate Sonika Motten appearing on behalf of accused persons had submitted before the Court that accused are innocent persons and were falsely implicated by the police in the false and frivolous case.
On the other side, APP Pawan Preet Singh appearing on behalf of UT has resisted the bail application on the ground that the offences are non-bailable and serious in nature in which accused cannot claim bail as a matter of right.
In this case on the basis of confession made by the accused persons, police recovered gold and other valuable items. The instances of theft related crime are increasing and granting bail to the accused persons shall give adverse message to the society.
After hearing the arguments of both sides, the Court rejected the bail application of the accused on the ground that the investigation of the case is still in the initial stage in which the investigating agencies are leading towards more recoveries and while granting bail, the Court has to see the nature and gravity of granting bail and the stage of investigation. It will not be in the public interest to allow the bail application at this stage.
