Bail denied to two brothers in rape case

JAMMU, Sept 18: Presiding Officer Fast Track Court Jammu Khalil Choudhary has denied bail to two brothers who have been booked for committing rape.
The accused persons namely Jamesh Kumar and Sandoor Kumar, sons of Jagan Dass of Salehar, Bishnah had committed rape with the prosecutrix in a vehicle and accordingly FIR under Sections 376-D, 506 and 34 IPC was registered against them at Police Station Pacca Danga.
After hearing Advocate Deepika Singh Rajawat for the applicants and Additional Public Prosecutor Suresh Sharma for the UT, the Presiding Officer observed, “rape is the most morally and physically reprehensible crime in the society and assault on the body, mind and privacy of the victim”.
“As observed by the Supreme Court in a catena of decision, while a murderer destroys the physical frame of the victim, rapist degrades and defiles the sole of the helpless female”, the court said, adding “being the most hated crime, the rape tantamount to serious blows to the supreme honour of women and offends both her esteem and dignity”.
“On overall analysis of the matter in its totality, I am of the considered opinion that at this stage there appear a reasonable grounds for believing that accusation alleged against the applicants/accused are prima facie true and as such there appears to be no merit and substance in the bail application of the petitioners”, the Presiding Officer said while rejecting the plea.
