Bail denied to narco smuggler

JAMMU, May 6: Principal Sessions Judge Reasi Kamlesh Pandit has rejected the bail application of one Rakesh Kumar, son of Birbal of Aggar Jitto, who was arrested by the police for selling heroin.
After hearing both the sides, the court observed, “drug menace is burgeoning with pace and its perpetuators are designing every day a new mode to introduce it to younger generation”, adding “the adverse effect of such drugs is dependence syndrome, psychological and mental disorder followed by symptoms of stress or disorder”.
“The offence committed by the accused has deleterious effect on the public at large and courts have to act strictly in view of the virulent progression of such crimes. The offenders are destroying the future and health of young populace of our country under a well planned stagey”, the court said, adding “though the right to liberty is a fundamental right and the citizens are free to move anywhere in the country but presently reasonable restrictions have been imposed to prevent the spread of corona virus and the medical experts have impressed upon social distancing and in such circumstances release of accused/applicant herein at the cost of breaching the order of lock-down and at the cost of risking lives of many cannot be considered to fall within the category of extreme urgent matter”.
With these observations, court rejected the bail application.
