JAMMU, Jan 21: Principal Sessions Judge Samba Mohd Akram Chowdhary has rejected the bail application of a retired CRPF cop, who was booked under NDPS Act.
After hearing Public Prosecutor Jawaid Khawaja for the UT, the court observed, “the quantity of contraband recovered from the applicant falls in intermediate quantity, therefore bar of Section 37 NDPS Act is obviously not applicable to the instant case”.
“The offence of which the applicant has been accused carries punishment of 10 years imprisonment and fine of Rs 1 lakh. Given to the severity of punishment, the offence is serious in nature. Otherwise also the menace of trade and use of narcotic drugs and psychotropic substance has become alarming to society in general and young generation in particular” , the court said.
“This menace requires to be curbed with a heavy hand as it is eating into vitals of the polity. The case of applicant is at initial stage of investigation and having regards to the facts and circumstances of the case, particularly the serious in nature of offence, the applicant is not entitled to get bail at this stage”, the court said.
