JAMMU, May 6: Special Mobile Magistrate Passenger Tax Jammu, O P Bhagat today rejected the bail application of four Nigerians, who were arrested by the Gandhi Nagar Police from Mumbai for cheating a Jammuite worth Rs 5 lakh.
After hearing Senior PO Vijay Sudan appearing for the State whereas Advocate Monika Kohli appearing for the accused persons, Special Mobile Magistrate observed, “the investigation of the case is at its initial stage and in present case there is sufficient evidence on record which made the court to believe that accused persons are prima-facie involved in the commission of offences”.
“The law with regard to grant of bail is not static and each case is judged on its facts and circumstances but in the instance case accused persons are foreigners as such probability of the accused persons absconding is very high”, the court further said, adding “there is every apprehension that accused persons will jump over the bail and it will become difficult to procure their attendance during the investigation as well as trial of the case”.
With these observations, court rejected the bail application.
