Bail denied to 4 in kidnapping, rape case

JAMMU, Dec 6: Principal Sessions Judge Reasi Kamlesh Pandit today rejected the bail application of Fareed Ahmed, Bashir Ahmed, Gulam Quadir and Abdul Qayoom, who were allegedly involved in kidnapping and rape of a minor in Chassana area of Reasi.
After hearing both the sides, the court observed, “in this case two accused persons are absconding against whom proceedings under Section 512 CrPC are in progress and charges are yet to be framed”.
“There is also no change in the circumstances under which the earlier bail application of the accused persons/applicants was rejected. Therefore, without discussing further merits of the case in this bail application, I am not convinced to exercise any discretion in favour of the accused persons/applicants in view of the statutory bar under Section 32 of the POCSO Act and also due to the gravity of the offence as well as in the interest of justice”, the Judge said.
“The offences alleged to have been committed by the accused persons are very much against the ethos of our culture and against the interest of the public at large. Any sexual assault upon a girl child that too a minor, is termed as most heinous and dastardly acts having social, psychological, physical and emotional repercussions on the life and prospects of a victim”, the court said, adding “the new legislation has been enacted with an object to deal with an iron fist on the offenders due to the ever increasing intensity of incidents of sexual violence against the children/minors”.
