Bail denied to student in NDPSA case

JAMMU, July 1: Special Judge M A Chowdhary has rejected the bail application of  Zabeer Ahmed, a student of IGNOU, who was booked under Narcotics Drugs and Psychotropic Substances Act.
According to the police case, Zabeer Ahmed, son of Abdul Karim of Gool Ramban and presently putting up in Prem Nagar area of Christian Colony  was arrested on April 27, 2017 along with 54 grams of heroin.
After hearing Advocate Prince Khanna appearing for the applicant whereas APP Ajay Singh Manhas appearing for the State, Special Judge under NDPS Act observed, “54 grams of heroin has allegedly been recovered and seized from the possession of accused which falls within intermediate quantity”, adding “as per the notification specifying quantities, small quantity is  05 grams and commercial quantity is 250 grams  and on conviction, offence of which accused has been charged with entails ten years rigorous imprisonment  with  fine up to Rs one lakh”.
“Having regard to the nature of the offence and gravity of punishment for the offence of which the applicant /accused has been charged with, granting bail in such cases shall be misplaced sympathy”, the court observed, adding “the challan is subjudice and if accused is released on bail, he may tamper with the prosecution evidence”.
With these observations, court rejected the bail application.
