JAMMU, Feb 21: Special Judge Anticorruption Jammu Y P Bourney has acquitted ASI Ranjit Singh from the corruption charges as prosecution failed to prove its case.
After hearing Advocate KS Charak for the accused, court observed, “complainant’s version that accused had a deal with him in furtherance whereof accused retained Rs 1500 recovered upon his personal search has been found factually incorrect as the amount was clearly reflected by the accused as investigating officer in the memo of personal search of complainant which was later on forwarded to the court in due course upon the presentation of the charge-sheet”.
“The story of deal for the release on bail also does not find favour from any of the circumstances as the witness who stood as surety for the complainant and as such would have naturally the inkling, has negated the same while deposing as witness for defence”, the court further observed, adding “further, the acceptance of surety of a person who was not even known to the complainant and that too three days earlier belies such a stance”.
“Therefore, the possibility of instant case being foisted on account of the feelings of vengeance can’t be over-ruled”, the court said, adding “prosecution has not been able to prove its charges against the accused beyond a reasonable doubt as such accused is acquitted”.
