Srinagar, Dec 9: High Court today directed for continuation of services of employees of Social Welfare Department (SWD) who were recently disengaged by the Government, with the condition if they are as on date performing their duties.
The 918 employees from Helpers to Supervisors working in the Social Welfare Department were disengaged by the Government on the ground that they have been engaged beyond any competence by the officials from time to time.
Justice Ali Mohammad Magrey directed that the employees be allowed to continue to work with the condition if they are in service as on date.
Advocate T A Lone appearing for petitioners submitted before the court that they have not been disengaged by Mission Director by any separate order, and the petitioners having being engaged by competent officers, however, the petitioners are being conveyed by respondents that the petitioners are deemed to be disengaged under the said Order.
That the petitioner-employees came to be engaged as Helpers to Supervisors under Integrated Child Development Scheme (ICDS) in different ICDS Projects to assist the Supervisors in implementation of the Scheme through various Anganwadi Centers.
Court meantime asked the Commissioner/Secretary to Government, Social Welfare Department, Mission Director, ICDS, J&K, Deputy Director ICDS Kashmir, District Programme Officer, ICDS Projects, District Baramulla, District Programme Officer, ICDS Projects, District Bandipora, District Programme Officer, ICDS, District Srinagar. CDPO, ICDS Project Zaingeer, District Baramulla, CDPO, ICDS Project Sopore, District Baramulla, CDPO, ICDS Project Wagoora, District Baramulla, CDPO, ICDS Project DangiwachaRafiabad, District Baramulla, CDPO, ICDS Project Bandipora, District Bandipora and CDPO, ICDS Project Khanyar, District Srinagar to the plea of these employees.
These employees have prayed before the court that the respondents be directed to allow them to continue to work as Helpers to Supervisors in the concerned ICDS Projects, and also abstaining the respondents from disengaging the petitioners from the post of Helper to Supervisor in their respective ICDS Projects.
The decision of disengagement of their services was taken in a meeting held on August 27 under the Chairmanship of Advisor to Governor whereunder it was decided that 918 helper to supervisors who have been engaged unauthorizedly by field agencies of ICDS, J&K from time to time without any sanctioned posts need to be immediately disengaged.
Thereafter the Additional Secretary to Government Social Welfare Department issued an order to Mission Director ICDS, J&K advising him to immediately disengage these employees w.e.f September 1.
