SRINAGAR, Dec 22: The State High Court today directed the authorities to take remedial steps against the unregistered coaching centers throughout the State and to comply with all its directions.
After perusal of the report of Judges’ committee formed by the court in order to find out the registered and unregistered coaching centers, Court said report be furnished to all concerned including Divisional Commissioners of Kashmir and Jammu for taking necessary remedial measures about the issue.
Court had constituted a two-member committee comprising two former District and Sessions Judges – Ghulam Mohi-ud-Din Dar and Abdul Wahid- to verify the statement made to the undertaking filed by the coaching centers in compliance to the court orders.
“Registry to send copies of the report of Judges’ committee to all the concerned authorities including the Divisional Commissioners of Kashmir and Jammu. The authorities shall take further corrective steps in light of the report of Judges committee”, Justice MH Attar and Justice Ali Mohammad Magrey directed.
Meanwhile, court directed all respondents to comply with all the directions, issued in this case, from time to time. “Compliance report, in this regard, also be filed before next date of hearing”, DB directed.
Court had also constituted three-member committee headed by Divisional Commissioner Kashmir with Director School Education and Inspector General of Police, Kashmir, as its members. The committee was asked to immediately close down all unregistered tuition and coaching centres wherever functioning in the Kashmir division.
Court had directed the Judges’ committee to inspect all the coaching/tuition centers and find out as to whether the undertakings given in the court are correct and whether they (coaching centers) have compiled with the J&K Regulation of Private Tuition Centers Rules of 2010.
In order to secure the interests of children who are studying in the unregistered coaching and tuition centres, the Court had directed the owners and the authorized persons of the institutes not to operate their bank accounts which stand in their names.
A similar committee (comprising Divisional Commissioner, Direction School Education and IGP) for Jammu Division shall stand constituted as has been constituted in Kashmir Division and all the directions issued with regard to Kashmir Division have been extended to the said committee.
The coaching and tuition centres functioning in Jammu, court had said, shall file undertakings that they comply with 2010 Rules and court directions before the Divisional Commissioner Jammu. The Divisional Commissioner Jammu was asked to notify the order to all the coaching and tuition centers operating in division-10 districts.
