Excelsior Correspondent
Srinagar, July 25: The High Court today while reserving the judgment observed that former Board of Professional Entrance Examination (BOPEE) chairman, Mushtaq Ahmad Peer, has committed one of the worst offences.
Justice M K Hanjura reserved his order on suspension of sentence given to Mushtaq Peer by trial court in Common Entrance Test (CET) paper scam.
Peer approached the Court by way of an appeal challenging the sentence given to him by the Special Judge Anti-Corruption on April 25 this year in CET paper scam.
Peer besides setting aside of trial court verdict against him has filed an application for suspension of the sentence awarded to him by the court.
Justice M K Hanjura while hearing the petitioner-Peer’s counsel and State counsel reserved orders with the observation that the instant case is one of the worst cases in view of offence.
Peer’s counsel has sought suspension of the sentence till the main appeal is heard and considered by the Court but the State counsel B A Dar (Sr. AAG) vehemently opposed the submission of petitioner-counsel.
Advocate Dar submitted before the court that the accused is main culprit in the scam and misusing his office he not only committed a heinous offence but also destroyed the career of meritorious candidates and defamed the name of BOPEE in the eyes of general masses and therefore, didn’t deserve for suspension of sentence.
Peer has been sentenced and convicted to undergo rigorous imprisonment of 16 years and fine of Rs one crore  in view of his involvement in the crime and is presently lodged at Central Jail Srinagar.
