UDHAMPUR, Oct 30: Additional Sessions Judge Udhampur, M K Sharma today awarded two years rigorous imprisonment and fine of Rs 1000 to Pawan Kumar, son of Hans Raj of village Jakhed, tehsil Ram Nagar in attempt to rape case.
According to the prosecution case, on the night of August 27, 2007 the accused armed with a rifle entered the house of the complainant and made an unsuccessful attempt to commit rape upon her on the gun point. The complainant and her minor daughter raised hue and cry and the accused fled away.
On the threat of the accused, the complainant did not disclose the incident to any body and waited for her husband to come home. When husband of the complainant did not come home till evening, the complainant went to Police Post Punara where husband of the complainant was posted as SPO and narrated the incident to her husband. Accordingly, a case was registered at Police Station Basantgarh.
After hearing APP Tariq Mujahid Mughal appearing for the State whereas Advocate Anil Vijay Kumar for the accused, Additional Sessions Judge observed, “the convict faced the trial for more than five years. In view of the facts and circumstances of the case, the convict Pawan Kumar is sentenced to rigorous imprisonment for two years and fine of Rs 1000 for the commission of offence under Section 376/511 RPC and rigorous imprisonment for six months and fine of Rs 500 for the commission of offence under Section 451 RPC. All the sentences shall run concurrently”.
