DB disposes of PIL highlighting conversion of Basmati growing land

JAMMU, Nov 22: Division Bench of State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today disposed of a Public Interest Litigation (PIL) regarding conversion of Basmati rice growing land into concrete jungle.
After hearing both the sides in length, DB observed, “latest compliance report filed by Deputy Commissioner Jammu, though indicates other area(s) as well, where such illegal conversion of agricultural land is at galore, yet, neither petitioner nor respondents have pointed out any such illegal conversion specifically”.
DB further observed, “we have a legislation called as the Jammu and Kashmir Land Revenue Act that deals with all facets, matters and issues concerning making and maintenance of records-of-rights in land, assessment and collection of the land revenue, prevention on conversion of land and all other matters”, adding “Section 133-A of the Jammu and Kashmir Land Revenue Act gives efficacious remedy to take care of such situation, including what has been groused by the petitioner in the present PIL, and the concerned revenue functionary under the auspices of the Act, can very well deal such situation with iron hand”.
With these observations, DB disposed of the petition giving liberty to the petitioner to approach the concerned authority as provided in the Jammu and Kashmir Land Revenue Act, which shall proceed in the matter in accordance with the Act.
