DB directs violators to furnish response to notices before Oct 16

JAMMU, Sept 27: Division Bench comprising Justice Virender Singh and Justice Muzaffar Hussain Attar has directed the violators of the Supreme Court’s directives on use of black films and tinted glasses to respond to the notices issued to them on or before the October 16, the next date of hearing.
In a detailed order issued in the PIL titled Dr Devinder Singh Jasrotia Versus State and others after hearing Advocate Rohit Kapoor appearing for the petitioner and battery of lawyers for the respondents and owners of the seized vehicles, the DB said, despite making the public at large aware about the consequences of the plying of commercial and private vehicles in violation of the judgement of Apex Court on the subject and the rules govering the field, the applicants/ authorized owners of the vehicles, who have not bothered to obey the rules and have violated the directions issued by the Apex Court as such they are put to notice to explain their position as to why action warranted under law be not taken against them”.
“They have to explain their position in response to the notice on or before the next date of hearing—October 16”, the DB said while directing the applicants to furnish undertakings before the DIG Traffic that they will not ply their vehicles in violation of directions passed by the Apex Court and also the rules governing the field. “In case, any adverse order is passed by this court against the applicants, in that event, they shall surrender their vehicles before the concerned authority”, the DB added.
These directions were in reference to the objections of Advocate Rohit Kapoor, who submitted that offenders cannot be let off and some action should be initiated against them for violating the norms as also plying the vehicles in violation of the directions passed by the Supreme Court and Division Bench of State High Court.
Pointing towards the submission made by Advocate Rohit Kapoor that merely issuance of mandamus directing the agencies concerned to perform their duties would not be sufficient enough and a constant check has to be made to see that no one acts in violation of the directions issued by the Apex Court particularly by the police vehicles, the DB directed the Inspector Generals of Police, Jammu and Srinagar Zones to file personal affidavits indicating that no police vehicle will be permitted to ply on the roads in violation of the laid down norms as per the Motor Vehicles Act and Rules. “The affidavits shall be filed by the officers on or before the next date of hearing”, the DB added.
