Court issues NB warrant against Hizb supremo

Srinagar, Dec 20: The Special Judge Budgam designated under NIA Act has issued non-bailable warrants against banned Hizbul Mujahideen (HM) militant outfit commander Mohammad Yusuf Shah alias Salah-ud-Din for evading arrest in FIR registered against him way back in 2012.

The public prosecutor has sought issuance of non bailable warrant against the accused-Mohammad Yusuf Shah alias Salah ud Din of Bonpora Soibugh, supremo of Hizbul Mujahideen on the basis of an application of the I.0 of FIR No. 331/2012 under Sections 13, 18, 20, 39 of UAP Act and 506 of RPC.
The public prosecutor submitted that the accused is found involved in FIR No. 331/2012 for the commission of crime under Sections 13, 18, 20, 39 of UAP Act and 506 of RPC, however, he has crossed over the border and is presently residing in Pakistan.
The court has been informed that the concerned police station has issued two separate certificates indicating that the accused-Shah @ Salah ud din has infiltrated into Pakistan and could not be traced.
The court said that since, the offences levelled against him arises out of Unlawful Activities (Prevention) Act and has been booked for the commission of crime under Sections 13, 18, 20 and 39 of UAP Act besides 506 of RPC as such the court is being the Court of Sessions acts as a Magistrate the Chief Judicial (specifically for custody/bail matters) primarily under Section 43-D (2) and (5) of UAP Act.
“This Court has drawn the satisfaction from the CD that the accused Mohammad Yousuf Shah alias Salah ud Din is evading the arrest, as such, a non bailable (NB) warrant is issued against the accused with the direction to the police of Jammu and Kashmir to arrest him in connection with FIR No. 331/2012 for the commission of crime under Sections 13, 18, 20, 39 of UAP Act and 506 of RPC”, the Presiding Officer of the NIA court directed.
