Srinagar, Aug 21: High Court has sought personal appearance of Deputy Commissioner Srinagar in case reply is not filed by him to the plea seeking enhancement of rent for occupation of house by the Security Forces nearly 34 years ago.
Justice Rahul Bharti granted last and final opportunity to DC Srinagar to submit his reply by or before August 30 after the Police Department informed the court that with respect to enhancement of rentals the matter was taken up with the DC concerned way back in August 2024 as being Chairman of the Rent Assessment Committee.
The court noted that the response from DC’s end has not come forth, meaning thereby, at the time of filing of objections on 17.12.2024, involving a period of almost one year, the Deputy Commissioner, Srinagar as being Chairman DRAC had not found time to spare for considering the requisition of the respondents 1 to 3.
“This court grants last and final opportunity to the respondent to come forward with the detailed reply to the writ petition by or before 30th of August, 2025, failing which the Deputy Commissioner, Srinagar, shall remain present in person before this court”, Justice Bharti directed.
The residential house of the petitioners is under use and occupation of the security forces since 1990 but the payment of rent taking place without any revision and also no scope being seen by the petitioners for their occupied residential house property’s vacation by the Security Forces and that is the core of cause of the petitioners’ writ petition.
