JAMMU, Nov 28: The Central Administrative Tribunal (CAT) Jammu Bench has imposed a cost of Rs 50,000 on the Government for not giving joining letter to a migrant namely Ashok Kumar to whom the appointment letter was issued on the directions of the High Court of J&K.
An order in this regard has been passed by the Division Bench comprising Rajinder Dogra (Judicial Member) and Ram Mohan Johri (Administrative Member).
The applicant was selected as a teacher by the J&K Services Selection Recruitment Board under the Prime Minister Special Package for return of Kashmiri Migrants to Kashmir Valley and their rehabilitation. The applicant was appointed as teacher on 24.11.2010 but due to the upper age limit the respondents did not select him and he approached the High Court, which directed the SSRB to consider his case for relaxation in upper age.
Pursuant to the directions of the High Court, SSRB issued the appointment letter to applicant and he was posted in District Kulgam but the unfortunate part was that he was not allowed by the concerned officials to join in the school so the applicant once again approached the High Court. Later, the matter was transferred to CAT and respondents failed to give any plausible reason not allowing the applicant to join despite clear directions from the High Court.
The CAT, while allowing the petition, has imposed a heavy cost of Rs 50,000 upon the erring respondent official who have not allowed the applicant to join, because if the appointment letter has been issued by the SSRB it means he stood appointed and his upper age has been relaxed as per the directions of the High Court.
