Accused facing rape charges acquitted

JAMMU, Sept 10: Principal Sessions Judge Poonch, Jaffer Hussain Beigh has acquitted an accused, who was facing trial in kidnapping and rape of the prosecutrix.
After hearing Public Prosecutor Nazir Hussain for the State whereas Advocate Anuj Kapoor for the accused, Principal Sessions Judge observed, “the prosecutrix has not stated anything against the accused. She was declared hostile and in cross-examination by the Public Prosecutor she has deposed in clear terms that the accused has neither kidnapped her nor committed any rape”.
“In view of the statement of the prosecutrix there is no need to ask the prosecution to lead further evidence. Two more witnesses namely Abdul Latief and Khalid Hussain have already been examined by the prosecution and both these witnesses were also declared hostile by the court at the request of the prosecution and when cross-examined by PP they have not stated anything incriminating against the accused”, the court said.
“In view of these facts it will not be justified to give further lease of life to the instant case because no amount of witnesses produced by the prosecution can negate the version put forth by the prosecution. Accordingly, evidence of the prosecution is closed”, the court said while dismissing the challan and acquitting the accused of the charges leveled against him.
