JAMMU, May 9: State High Court has stayed the operation of final common seniority list of Junior Scale Stenographers belonging to J&K Economics and Statistics Ministerial Staff.
After hearing Advocate Abhinav Sharma appearing for the petitioners, Justice Tashi Rabstan observed, “it is contended that one of the petitioners being senior most Junior Scale Stenographer is entitled to be promoted as Senior Scale Stenographer in place of one Ashok Kohli, who retired on March 31, 2013 as Incharge Senior Scale Stenographer Divisional Cadre, Jammu”, adding “it is also contended that in this regard petitioner Manmohan Kour made a representation to the Director Economics & Statistics requesting therein to provide copy of seniority list of Stenographers of Jammu Division Cadre”.
“On April 25, 2013 both the petitioners made representation to Director Economics & Statistics stating therein that they had come to know that the respondent-dept had issued common seniority list of Junior Scale stenographers but the petitioners were unaware of any such notice and prayed that the case of both petitioners who are at serial No 1 & 2 in Jammu Division Cadre be considered for promotion to the next higher grade of senior scale stenographer”, the High Court observed.
“On examination of the documents annexed with the writ petition, coupled with the submissions made at the bar, prima-facie, a case for indulgence of this Court, is made out”, Justice Rabstan said and issued notice returnable within four weeks. In the meanwhile subject to objection from the other side and till next date of hearing operation of final seniority list of Junior Scale Stenographers belonging to J&K Economics and Statistic Ministerial Staff was stayed.
