Prosecution failure leads to acquittal of 2 narco smugglers

JAMMU, May 7: Principal Sessions Judge Kathua M K Hanjura today acquitted Amrik Singh, son of Surjan Singh of Moga and Raman Misra, son of Ram Gopal Misra of UP, who were facing trial in NDPS case, as the prosecution failed to prove its case.
According to the prosecution case, on April 5, 2007 a gas tanker bearing registration No HR-38L3416 was proceeding towards Lakhanpur. When it was intercepted and subjected to checking by a police patrol party at Kalibari six packets containing poppy straw were recovered.
After hearing Advocate B B Bhagotra for the accused persons whereas Public Prosecutor Ravi Kumar for the State, Principal Sessions Judge observed, “the samples have been sent to the chemical analyst after a long time. There is disparity in the weight of the sample sent to the laboratory and the sample allegedly taken on spot. The DySP, who is alleged to have dispatched the sample for chemical analysis, has not been examined as a witness”.
“The carrier of the sample to the laboratory has also not appeared as a witness in the case. The prosecution has thus failed to connect the accused with the crime. The prosecution case straightaway merits dismissal and consequent acquittal of the accused”, the Court said.
With these observations, the Court acquitted the accused of the charges leveled against them.
