7 yrs imprisonment awarded in rape case

JAMMU, Jan 7: Principal Sessions Judge Rajouri Jaffer Hussain Beg has awarded seven years imprisonment to one Attinder Pal Singh, son of Joginder Singh of Akhnoor in a rape case.
According to the prosecution case, the accused had committed rape upon the prosecutrix in the year 2014-15 after enticing her by promise of marriage.
After hearing Public Prosecutor Shaheen Ahmed Khan and Advocate Inderjeet Sharma for the accused, the court convicted the accused for the offence under Section 376 (1) RPC and observed, “the counsel for the accused has prayed for minimum punishment prescribed under law because the convict is an Army person and due to conviction he would lose Government job but the Public Prosecutor has argued that the accused has committed heinous offence and the court cannot ignore the prevailing law and order conditions in the society and forget the victim of the crime so the maximum punishment be awarded to him”.
“The offence under Section 376(1) RPC committed by the accused is punishable with imprisonment of either description for a term which shall not be less than seven years but which may be for life or for a term which may extend to ten years, and shall also be liable to fine”, the court said, adding “the trial in this case has taken about four years and the accused is an Army official who would lose his job after his conviction in the case”.
Accordingly, the court awarded seven years rigorous imprisonment to the convict and imposed fine of Rs10,000. In default of payment of fine he shall further undergo imprisonment of like nature for 6 months.
