JAMMU, Mar 1: 1st Additional Sessions Judge Jammu M A Chowdhary today awarded five years imprisonment and fine of Rs 10,000 each to Sham Lal, Ajeet Singh and Suraj Singh, who were facing trial in attempt to murder case.
After hearing APP Ajay Singh Manhas appearing for the State, 1st Additional Sessions Judge M A Chowdhary observed, “in view of the settled law, the underlying principle in sentencing is that showing undue sympathy in favour of the convict as compared to the societal interests, is not desirable and that the appropriate sentence, commensurate to the gravity of the act of offence should be imposed, which may also serve as a deterrence”.
“Having regard to the young age of the convict on the date of commission of offences and the inordinate protracted trial for more than two decades which are extenuating circumstances, a lenient view is required to be taken”, the court said.
With these observations, court awarded five years imprisonment to the accused for the commission of offence punishable under Section 307 RPC.
