JAMMU, Oct 26: Chief Judicial Magistrate Jammu, S R Gandhi today awarded three years rigorous imprisonment to one Gopal Krishan, driver of matador whose rash and negligent driving caused the death of a scooterist Rajinder Singh on January 14, 2004. After hearing CPO Sanjay Kohli with Senior PO Rajeshwar Basotra appearing for the State, CJM observed, “prosecution has proved its case beyond reasonable doubt that accused while driving the matador in a rash and negligent manner at the public place caused the death of a scooterist”.
While awarding three years RI to driver, the Court observed, “a tendency has grown amongst the drivers to run away after the accident rather than taking care of the injured by shifting in the nearby hospital for the timely medical aid which may save the precious life of the victim but showing disregard to the humanitarian approach, the drivers tend to flee from the justice depriving the victims of even the benefit of social legislation for claiming the compensation”.
