3 yrs imprisonment awarded to Veterinary Health Officer

JAMMU, Mar 1: The Court of Anti-Corruption Jammu today convicted and sentenced two year imprisonment to M L Gupta, then Veterinary Health Officer, Jammu Municipal Corporation and his conduit Jaswant Lal, who were caught red handed while demanding and accepting bribe from a meat seller in 2011.
The court after conducting a full fledged trial of the case, convicted and sentenced both the accused persons with simple imprisonment of two years and a fine of Rs 15,000/- each under section 5(1) (d) punishable under section 5(2) of PC Act Svt 2006 and one year simple imprisonment and a fine of Rs 10,000/- u/s 161 RPC.
The chargesheet was filed against both the accused persons before the Additional Judge, Anti-Corruption Court, Jammu on 25.04.2013 after completion of the investigation and other legal formalities.
On September 3, 2011, one Riyaz Ahmed Bhat had lodged a verbal report at P/S Vigilance Organization Jammu alleging therein that M L Gupta, Veterinary Health Officer of JMC Jammu, came to his shop and lifted the meat (flesh). On questioning by the shop owner as to why he lifted the meat from his shop, the said Veterinary Officer reasoned that the former was not paying Rs 2000/- per month as bribe.
As the complainant approached Vigilance Organization for seeking necessary action, a case FIR number 18/2011 u/s 5 (2) J&K PC Act r/w 161 RPC was registered in P/s Vigilance Organization Jammu against M L Gupta and he was caught red handed while demanding and accepting an amount of Rs 2000/- as bribe from the complainant. As the accused after accepting the bribe money had handed over the same to his conduit Jaswant Lal, both the accused were formally arrested.
