3 yrs imprisonment awarded in accident death case

JAMMU, Feb 13: Observing that a deterrent punishment is required in road accident cases, a local court has awarded three years imprisonment to a car driver.
According to the police case, on 02.08.2009 Police Station Nowabad received information that one Kamal Gupta, son of Bansi Lai Gupta of Janipur who was going on his scooter No. JK02B-1627 along with his wife Sapna Gupta and daughter Gunjan Gupta from Bikram Chowk to Janipur was hit by a car No JK02G-8191 being driven by Anil Singh Jamwal of Nanak Nagar on flyover.
The accident took place due to high speed, negligence and rash driving by car driver. The accused could not control his vehicle and crossed the road divider and hit the scooter on the other side. In the accident Kamal Gupta and his wife Sapna Gupta sustained severe injuries while as their daughter died on the spot.
Accordingly, a case was registered and investigation started. During the course of investigation Kamal Gupta also died. After completing the investigation police filed charge sheet against the accused.
After hearing APP Puja Nijhon appearing for the prosecution, Sub-Judge Jammu Pawan Kumar Sharma convicted Anil Singh Jamwal under Section 279/RPC and awarded imprisonment of six months and fine of Rs 1000.
The accused was also sentenced to imprisonment for 6 months under Section 337/RPC and one year imprisonment under Section 338/RPC. Three years imprisonment was also awarded under Section 304-A RPC.
All the sentences shall run consequently.
