JAMMU, Dec 27: Principal Sessions Judge Jammu, Kartar Singh today awarded 10 years rigorous imprisonment and fine of Rs 1 lakh to Mohd Maqbool Raina, son of Gh Mohadain Raina of Kokernag, who was facing trial in smuggling of charas.
After hearing D N Pangotra, Special PP for NCB, Principal Sessions Judge Jammu observed, “it has been proved that the accused was found carrying about eight kilogram charas. The minimum punishment provided for possession of commercial quantity of contraband is 10 years which may extend to 20 years and shall also be liable to fine which shall not be less than Rs one lakh rupees’.
“Where the contravention involves lesser that commercial quantity but greater than small quantity, the punishment provided is rigorous imprisonment for a term which may extend to ten years and fine which may extend to Rs one lakh. The accused is young men below the age of 34 years and is in custody since February 11, 2012”, the Principal Sessions Judge said, adding “in my opinion, the minimum sentence will meet the ends of justice”.
Accordingly, the accused was awarded rigorous imprisonment for a period of ten years and fine of Rs one lakh. In default of payment of fine, the accused will further undergo rigorous imprisonment for a period of one year.
