JAMMU, May 30: Additional Sessions Judge Udhampur, M K Sharma today awarded 10 years rigorous imprisonment and fine of Rs 1 lakh each to Nazir Ahmed, son of Abdul Khaliq of Srinagar and Abdul Aziz, son of Abdul Gani Khan of Fateh Kadal, who were facing trial under the NDPS Act.
These accused persons were arrested by police on January 30, 2012 at Jakheni and from the Honda city car, they were travelling in from Srinagar to Jammu, more than 18 packets of charas were recovered.
After hearing Additional Public Prosecutor Tariq Mujahid Mughal for the State and Advocate G S Shan for the accused, Additional Sessions Judge observed, “in this case prosecution has established not only possession of narcotics but conscious possession. It appears that the accused persons failed to find any exit route to come out of the cobweb of the prosecution case which has completely been proved in conformity with the provisions of NDPS Act”.
“The prosecution has therefore succeeded in connecting the accused with the commission of crime. The accused are accordingly convicted for the commission of offence under Section 8/20 NDPS Act”, the Court said.
Accordingly, the accused were awarded rigorous imprisonment for 10 years and fine of Rs 1,00,000 each to Nazir Ahmed and Abdul Aziz. Both were sent to District Jail Udhampur for serving the sentence.
