JAMMU, Oct 10: 3rd Additional Sessions Judge Jammu Subash C Gupta today awarded three years rigorous imprisonment and fine of Rs 10,000 to Bhagwan Dass alias Bittu under Section 354 RPC.
After hearing APP Surekha Kaw for the State whereas Advocates Manohar Singh & Raghubir Singh for the accused person, the court observed, “the accused is convicted for an offence relating to criminal use of force which led to outraging of modesty of the prosecutrix, a teenage girl”, adding “the accused does not deserves to be granted probation by invoking jurisdiction in compliance to relevant provisions of Section 562 of Code of Criminal Code”.
“Simultaneously, on taking into consideration the mitigation and aggravated circumstances as involved in the present matter, age of the accused, his past antecedent, first offender, gravity, heinousness and punishment provided for the commission of the offence under Section 354 of Ranbir Penal Code and other relevant factors, the accused is awarded rigorous imprisonment for a period of three years”, the court said.
