JAMMU, May 2: In a petition filed by Sunil Bali and 39 other ITI Diploma Holders in electrician trade alleging discrimination with them, High Court today directed the State to treat the petitioners at par with private respondents.
The petitioners submitted before the High Court that they were similarly circumstanced with those who stand engaged on need basis at the hand of the respondents by giving them the benefit of Cabinet decision vide Govt Order No 239-F of 2005 dated November 29, 2005 on the reasons that they have applied well in time for such purpose.
“The respondents were under an obligation to implement the Cabinet decision/ policy for the entire State and not for the Kashmir division only. The petitioners are aggrieved of the action/ in-action of the respondents in not extending the benefit of the policy to the Jammu Division”, Advocate Pranav Kohli appearing for the petitioners said.
After hearing Advocate Pranav Kohli for the petitioners, Justice Tashi Rabstan issued notice to Chief Secretary, Commissioner Secretary GAD, Commissioner Secretary PDD, Chief Engineer PDD Jammu, Chief Engineer PHE Jammu, Development Commissioner Power and J&K Service Selection Board through its Chairman returnable within six weeks.
Justice Rabstan also disposed of CMA with a direction to Chief Engineer PDD Jammu to adhere to the Cabinet Decision No 116/4 dated May 11, 2006 within notice period and in case petitioners are entitled to any benefit in terms of Cabinet decision, the same shall be extended to them.
