JAMMU, Dec 8: Traders Federation Ware House has moved High Court against toll tax at Lakhanpur, the gateway to Jammu and Kashmir.
In the petition filed by Rajesh Gupta, President Traders Federation Ware House/ Nehru Market, the collection of toll tax by the respondents at Lakhanpur under the Levy of Toll Act, 1995 has been described as illegal and ultra-vires the Constitution besides being contrary to the scheme and architecture of Goods and Services Tax (GST) regime.
The petitioner is also seeking direction to respondents to abolish purely in the public interest the Levy of Toll Act, 1995 in view of promulgation and implementation of the Central Goods and Services Tax Act, 2017, the Integrated Goods and Services Tax (Extension to Jammu and Kashmir) Act, 2017, the Central Goods and Services Tax (Extension to Jammu and Kashmir) Act, 2017 and the Jammu and Kashmir Goods and Services Tax Act, 2017.
“The continuation of the Levy of Toll Act, 1995 in the State of Jammu and Kashmir is defeating the basic spirit and architecture of the Goods and Services Tax regime which is aimed at building the entire country as a One Nation, One Tax, One Market”, the petitioner said.
