TADA court directs IGP to execute non-bailable arrest warrant

Srinagar, May 27: The special TADA Court today directed the Inspector General of Police, Kashmir range, to execute the non-bailable arrest warrant against owners of 7 drug companies, who failed to appear before the court in spurious drug scam while it granted an interim bail to Managing Director M/s Medley Pharmaceuticals Pvt Ltd.
Special Magistrate, Muzaffar Iqbal Qureshi of the TADA Court, designated as Special Court to hear cases related to spurious and adulterated drugs, today passed the directions on a complaint filed by the State through Drug Inspector, Zone-VI, Srinagar, seeking directions for action against the accused for offences related to supply of spurious drugs.
The standing counsel for Drug Control, Advocate Musavir Rafiq Joo argued that the accused drug manufacturing companies have violated various sections of Drugs and Cosmetics Act 1940 and deserve punishment.
The Court earlier sent Surinder Kumar Sharma, Managing Director M/s Medley Pharmaceuticals Pvt Ltd Medley House of Mumbai, to 3 hours judicial lock up. He was, however, later granted interim bail upto June 24 against bail bond of Rs 1 lakh after his counsel, Advocate Manzoor Ahmad Dar, filed an application before the court for interim bail.
The court directed that all the accused should be produced before the court on June 24, the next date of hearing.
The court directed IGP Kashmir range, A G Mir to execute the non-bailable arrest warrant against owners of 7 drug manufacturing companies who have failed to present themselves before the court. The IGP has been directed to constitute a team of police officers for the execution of non-bailable warrant.
Those against whom orders of execution of non-bailable arrest warrant has been issued are: Prem Prakash Barnwal of Uttar-Pradesh (Director of M/s Sanative Pharmaceuticals Pvt Ltd), Manjula Barnwal of UP (Director of M/s Sanative Pharmaceuticals Pvt Ltd), Ashok Kumar of Dehradun (Analytical Chemist of M/s Sanative Pharmaceuticals Pvt Ltd), Manoj Kumar Aggarwal of Patna-Bihar (Director M/s Sanative Pharmaceuticals Pvt Ltd), Rahul Kumar Singh of Dehradun, Bipin Kumar of Himachal Pradesh (Analytical Chemist of M/s Affy Parenterals), and Suraj Enterprises.
Advocate Vishal Sharma filed two attorneys before the court on behalf of Arvind Billa, Proprietor of M/s Affy Parenterals Village Gullerwala of Himachal Pradesh; Vilas Bhimarao Thorat of Himachal Pradesh, Manufacturing Chemist of M/s Affy Parenterals Village Gullerwala; Suneet Bhardwaj of Himachal Pradesh, Manufacturing Chemist of M/s Affy Parenterals Village Gullerwala; and Sanjay Mishra of Himachal Pradesh, Manufacturing Chemist of M/s Affy Parenterals Vill.Gullerwala. He sought exemption of their clients for personal appearance before the court today.
The court granted exemption to the four accused for their personal appearance before the court. However, they were asked to appear before the court on next date of hearing.
The Court has also directed the DIG Crime Jammu to produce three arrested accused before the court on the next date of hearing. It may be mentioned here that Akhil Gadoo of Tomal Colony Bohri Jammu, Amardeep Raina of Muthi Jammu and Ashok Kumar Raina of Muthi Jammu (Proprietors of M/s Life Line Pharmaco- Surgicals) were arrested by Crime Branch Jammu in spurious drug scam.
It may be mentioned here that police registered cases against suppliers and manufacturers of Maximizine-625 drug that was supplied to hospitals across Kashmir valley after it was found spurious. The antibiotic tested negative for Amoxicillin while the company had claimed that it contains 500 miligramme of Amoxicillin.
The drug, Maximizine 625 milligram, along with several other drug were chosen in random sampling for laboratory testing by the Drug Controller Kashmir during winter. The drug were sent to the laboratory for testing and the anti-biotic tested negative as the laboratory report revealed that it contains “NIL” Amoxicillin. The drug contained Zero milligrams of Amoxicillin tri-hydrate while the company claims that it contains 500 milligrams of Amoxicillin tri-hydrate + 125 milligrams clavulanic acid.
