JAMMU, May 22; In a Letters Patent Appeal (LPA) filed against judgment of the Writ Court whereby petitions filed by Model Institute of Engineering and Technology (MIET) and 33 engineering students seeking regularization of their admission were dismissed, Special Division Bench of High Court comprising Justice Ali Mohammad Magrey and Justice Janak Raj Kotwal today issued notices to the Commissioner Secretary Technical Education Department, Commissioner Secretary ARI and Trainings, BOPEE through its Secretary, University of Jammu through its Registrar, Controller of Examinations, JU and MIER.
During the course of the arguments, Advocate Anil Sethi appearing for the BOPEE submitted that one more LPA has been filed against the judgment impugned, which is pending decision before this Court and subject to objections and till next date, the petitioners shall be allowed to sit in the classes at their own risk and responsibility.
After hearing Senior Advocate AH Naik with Advocate Rupinder Singh, Advocate Anil Sethi and Advocate W S Nargal, who was appearing for JU, the DB clarified that mere sitting in the classes shall not confer any right, whatsoever, on the appellants and called the record of the writ court.
