SMC illegally converts permission for residential construction into commercial

Despite stay structure stands completed

Srinagar, July 15: After issuing permission for the construction of two residential houses in the heart of Srinagar, an owner manages to get an amended order allowing the construction of a commercial structure instead from the Srinagar Municipal Corporation (SMC).
Though, the SMC has stayed the order asking the owner to stop all the works, however, the owner has managed to complete the structure and might soon start operating it.
The SMC had issued an order vide number 3439of 2018 dated 27/11/2018 in favour of Habibullah and Rashid Anwar allowing the construction two-storied two residential houses at Gogji Bagh Srinagar, however, the owner resorted to violations and later managed to get an amended order converting the residential order into commercial.
The locals said that said that the owner started the construction and openly flouted and violated the order and made several deviations and went on to construct three stories instead of two which is no way a residential.
After this, the owner got an amended order from SMC under number 299-of 2019 dated 11/10/2019.
”We were shocked by the fact that the SMC converted the residential order to commercial whereby the allottee was allowed to construct a Guest House,” the locals said.
“The allottee has constructed the said building and made many deviations, though the municipal authorities have stayed his permission through Special Tribunal, but still he has completed the structure inspire of the fact that we raised serious objections but nobody heard our please,” the residents said.
The residents have alleged that the order issued by the SMC is totally in contravention to municipal laws applying in residential areas has outraged the residents of the area and has also vitiated the atmosphere.
”These buildings which are almost complete and once they get inhabited, will put a severe strain on our limited civic amenities and will violate our privacy and modesty,” they said.
In order to get the official stand of the SMC, Excelsior called the Commissioner, SMC Gazanfar Ali as well as the Chief Enforcement Officer (CEO), Syed Nisar, both the officials did not respond to the repeated calls from this reporter.
However, Spokesperson of the SMC, Syed Qasim told Excelsior that he has received an application in this regard from the residents and the same has been forwarded to the CEO, SMC.
The residents of the area have demanded to scrap off the dubious order and put it in abeyance and at the same time issue a reprimand to the owner to seize all types of further construction “till the things do not fall on legal lines and are synchronized as per Municipal laws pertaining to the residential areas.”
