SKIMS rules out leakage of medical report of victim

Srinagar, July 3: Sher-i-Kashmir Institute of Medical Sciences Soura (SKIMS) today informed the court that there is no leakage of medical records relating to the examination of Bandipora alleged rape victim on their part.
The medical report of alleged rape victim was uploaded on social websites and the court had sought explanation from the SKIMS authorities about the leakage. Today the status report stands filed by Inspector General of Police, Kashmir as well as by Medical Superintendent, SKIMS, Bemina, whereby it is submitted that charge sheet in the case arising out of FIR No. 81/2019 stands filed in the court of Sessions Judge, Bandipora on 25th May 2019.
“Needless to say that the case shall be proceeded expeditiously by the court concerned”, Division Bench of Chief Justice Gita Mittal and Justice Rashid Ali Dar said.
An affidavit has also been filed by the Medical Superintendent, SKIMS informing the court that there was no leakage of medical records relating to the examination of the victim in the case and that the same was handed over to the investigating officer. Court took the said report on record.
Meantime, court issued notice to the daily newspapers “Daily Afaaq and Kashmir Vision” to show cause as to why they have not filed their response. “Let the same be done within one week from today”, reads the order.
No compliance has been filed by the Information Department with regard to steps taken so for in terms of Section 44 of J&K POSCO Act. Counsel representing the department sought time to place the information before the court.
State counsel sought leave to place on record an action plan as directed to ensure linkage between Police Stations and the officers of the Legal Services Authority. Court directed to implement the plan by the Jammu and Kashmir Legal Services Authority and the J&K Police. “An action taken shall be placed before us by both the Director General of Police as well as the J&K State Legal Services Authority”, reads the direction.
