JAMMU, Feb 21: Principal Sessions Judge Reasi Kamlesh Pandita has acquitted Mohd Iqbal, Bashir Ahmed, Mohd Rafiq, Nazir Ahmed, Mohd Sharif and Mohd Saleem, who were facing trial in kidnapping and rape case, as prosecutrix turned hostile.
While acquitting the accused, court observed, “prosecutrix and complainant are star witnesses and edifices for such cases. But in this case both have demolished the prospect of the prosecution story. Other witnesses are formal witnesses but brother and sister of the prosecutrix have also toed the line of prosecutrix and did not support the prosecution”.
“The witnesses including the prosecutrix have also stood firm in their cross examination by the prosecution. Prosecutrix as well as other witnesses did not suggest involvement of accused in the alleged commission of rape and kidnapping”, the court further said while acquitting the accused.
