JAMMU, Feb 28: Principal Sessions Judge Ramban Mohd Akram Choudhary today awarded rigorous life-imprisonment and fine of Rs 55000 to one Pawan Kumar, son of Prem Nath of Batote, who committed murder of his cousin Rajinder Kumar.
According to the police case, on January 5, 2008 one Kamal Kishore, son of Chuni Lal of Ward No 2 Batote lodged a verbal report at Police Station Batote alleging therein that his brother Rajinder Kumar was killed by his cousin Pawan Kumar in view of the strained relations between them. Accordingly, Police registered a case and after completion of investigation presented challan in the court of law.
After hearing Public Prosecutor GN Manhas appearing for the State whereas Advocate Anil Bargotra for the accused, Principal Sessions Judge observed, “object of awarding sentence is to protect the society and to deter the criminals. The sentence has to be stern. By imposing meager sentence in view of liberal attitude or taking too sympathetic view will be counterproductive in the long run and against the interests of the society which needs to be taken care of”.
“Pawan Kumar has been convicted for the commission of offences of murder and house trespass punishable under Sections 302 and 449 RPC. The offence under Section 302 RPC is punishable with death sentence or rigorous life imprisonment and fine and offence punishable under Section 449 RPC is punishable with imprisonment, which may extend to ten years and fine”, Principal Sessions Judge said, adding “having due regard to the facts and circumstances of the case and taking into view all the factors, this Court is of the considered opinion that the murder has not been committed in a brutal, barbaric and diabolical manner to make it a rarest of the rare case to attract death penalty. The interests of justice shall be served with a sentence of rigorous life imprisonment and a fine of Rs 50,000 under section 302 RPC and rigorous imprisonment for a period of five years and fine of Rs 5,000 under Section 449 RPC”.
