Remove decayed fertilizer, clear sites or face action: DM to MD JAKFED

JAMMU, Aug 27: District Magistrate Jammu, Simrandeep Singh has invoked Section 133 CrPC against the Managing Director of JAKFED for prompt removal of decayed fertilizer, which is creating public nuisance. The MD has been directed to act by or before August 31 or be ready to face the action.
According to the official sources, the Director Consumer Affairs and Public Distribution Department has brought to the notice of the District Magistrate that JAKFED has been time and again asked to remove deteriorated/decayed fertilizer from seven sheds/ stores at Ware House, Chatha and on University Road.
It has also been brought to the notice of the District Magistrate that these stores had been occupied by JAKFED for a very long time and are presently not in use as the fertilizer kept there has deteriorated and decayed due to hardening over very long period of time.
The decayed fertilizers are generating four smell due to water logging and seepage and due to close proximity to the CAPD stores, the PDS ration stored there also faces the threat of pollution/contamination. Moreover, the inflammable nature of the decayed fertilizer also posses the threat of fire hazard.
Stating that CAPD has repeatedly been taking up the matter with JAKFED for vacation and removal of decayed fertilizer from their premises but no action has been taken till date, the CAPD Director even informed the District Magistrate that CAPD Minister during visit to the spot stressed for removal of public nuisance.
“I have personally observed that keeping of decayed fertilizers near CAPD stores/ration is injurious to the health of the people and there is a need to prohibit the continuance of this nuisance”, the District Magistrate observed.
Keeping this in view, the District Magistrate while exercising powers conferred under Section 133 of CrPC has directed the MD JAKFED to immediate mobilize his men and machinery and remove the nuisance caused by decayed fertilizer from all the sites by demolishing structures by or before August 31 or appear before him to show cause as to why this order may not be made absolute.
