Register FIR against DySP: CJM to IGP

SRINAGAR, Aug 6: Chief Judicial Magistrate (CJM) Srinagar has directed Inspector General of Police Kashmir to register FIR against a police officer in 24 hours for allegedly killing a man in Srinagar last month and sought his personal appearance.
The court has also issued non-bailable arrest warrant against Senior Superintendent of Police, Srinagar, for not implementing the court order.
CJM Srinagar, Masrat Shaheen, today directed registration of FIR against Deputy Superintendent of Police, Yasir Qadri, for his alleged involvement in the killing of a youth in Batmaloo area of Srinagar on July 10. “In order to uphold the supremacy of law, Inspector General of Police Kashmir is directed to lodge FIR against non-applicant within 24 hours”, reads the court order.
The CJM has also sought personal appearance of the IGP Kashmir before the court on Monday and directed him to file compliance report. “He (IGP) is further directed to cause his personal appearance before this court at 10 am on Monday along with compliance report”, reads the CJM order.
The court has also issued non-bailable arrest warrant against the SSP Srinagar. “Non-bailable arrest warrant is issued to SSP Srinagar through DIG Central Kashmir”, says the CJM.
The CJM has also issued show cause notice to SSP Srinagar asking him as to why contempt proceedings may not be initiated against him. “The SSP to show cause as to why contempt proceedings shall not be initiated against him, so that reference can be sent to High Court for initiating contempt proceedings”, the order reads.
The CJM orders came two days after Jammu and Kashmir High Court upheld its orders in case of killing of a youth in Batamaloo area of Srinagar. High Court asked the trial court to proceed against the authorities under contempt proceedings in case its orders are not implemented. It also directed that Magistrate shall proceed in accordance with law and if required shall adhere to procedure governing contempt proceedings.
A man Shabir Ahmad was killed in police firing in Tengpora area of Batmaloo, Srinagar on July 10. His father in his application before CJM Srinagar has submitted that the DySP took law in his own hands and killed his son in cold blood without any reason and rhyme. He had submitted that he filed an application with the SHO Batamaloo who refused to lodge an FIR against the DySP.
Police challenged the CJM order before the High Court but Justice Mohammad Yaqoob Mir dismissed the petition of the State challenging the orders of trial court (CJM) whereby it had directed the SSP Srinagar to lodge an FIR against police officer.
