Rape accused denied bail

SRINAGAR, Sept 22: Court of 2nd Additional Session Judge, Srinagar today rejected bail application of a rape accused, who has was arrested by Police Station Ram Munshi Bagh, Srinagar.
The accused, namely Nadeem Yousuf Labroo, son of Mohammam Yousuf Labroo of Dalgate, Srinagar, had allegedly raped a woman, resident of Saket Nagar Delhi, on the intervening night of August 1-2, 2021 at his houseboat where the victim along with her friend were staying since July 30, 2021. A case FIR number 109 of 2021 for offence under section 376 IPC was registered in this regard at Police Post Nehru Park.
The accused, through his counsel, said that in terms of Section 164 CrPC, the alleged victim herself had stated that she does not want to pursue the instant cases, which apparently means that no offence has been committed against her.
The APP resisted the application for grant of bail submitted by the accused by contending that the Police report suggests in clear terms about the involvement of the accused in the FIR for offence punishable under Section 376 of IPC.
After hearing counsels for both the sides, Second Additional Session Judge Mohd Ashraf Bhat observed that rape is a heinous crime which cannot be viewed with a leniency. “A rapist not only causes physical injuries but more indelibly leaves a scar on the most cherished possession of a woman i. e her dignity, honur, reputation and not the least her chastity,” observed the Judge, adding that the courts are, therefore , expected to deal with cases of sexual crime against women with utmost sensitivity.
“On an overall view of the case, having regard to the stage of investigation and gravity of offence, case for grant of bail is not made out in favour of the petitioner/accused. Resultantly, application for bail merits rejections and is accordingly rejected,” ruled the Judge and disposed of the application.
