Rape accused acquitted

JAMMU, May 9: Principal Sessions Judge Poonch, Jaffer Hussain Beigh has acquitted Mohd Akram, who was facing trial in rape case.
“Nothing is impossible in this world of today. The enmity is double-edged weapon. The enmity can also be the motive of the crime as well as of false implication of the accused in the case. On one hand, the prosecutrix was having illicit relationship with the accused and on the other hand on the basis of at least on this illicit relationship the husband, the brother, father and other relatives of the prosecutrix were inimical towards the accused”, the court said.
“In view of the enmity, when there is delay of 2 days of lodging the FIR and the doctor has certified that no intercourse has been committed with the prosecutrix on the day of the alleged occurrence, there seems ill intention of the husband of the prosecutrix and her brothers to implicate the accused in some false case by using the prosecutrix”, the court further said.
With these observations, court acquitted the accused.
