Prosecution failure leads to acquittal of narco smuggler

JAMMU, July 18: Principal Sessions Judge Ramban Mohd Akram Chowdhary today acquitted Abdul Rashid, son of Ali Mohd Dar of Anantnag, who was involved in smuggling of charas, as prosecution failed to prove the case.
After hearing both the sides, Principal Sessions Judge observed, “the prosecution story as a whole appears to be doubtful in view of the fact that IO told Prosecution witness Kunal Singh that he would show him a magic and that people had been saying that the accused had been arrested a day prior which rules out the possibility of recovery and seizure on the basis of information”.
“Prosecution has thus failed to prove its case. In this backdrop of the matter, the commission of offences by the accused has not been proved”, the court said, adding “prosecution has failed to prove its case to bring home the charge against the accused for the commission of offence punishable under Section 8/15 NDPS Act”.
Accordingly, the court acquitted the accused of the charges leveled against him.
