Prosecution failure leads to acquittal of kidnapping, rape accused

JAMMU, June 28: Presiding Officer of Fast Track Court Sanjeev Gupta has acquitted one Hassan Bhatti, son of Mohd Sharief of Prem Nagar, Jammu, who was facing trial in kidnapping and rape case as prosecution miserably failed to prove its case.
According to the police case, on May 7, 2009 father of the prosecutrix approached Police Post Gujjar Nagar and lodged a report to the effect that about 3/4 days back, prosecutrix had gone to visit the house of her maternal grandmother situated at Jogi Gate when she went missing.
The complainant also told the police that he has come to know that one Hassan Bhatti alias Sunny has kidnapped her daughter.
On this, police registered a case and started investigation. During the investigation police recovered girl and after completion of investigation challan was presented.
After hearing Advocate Prince Khanna for the accused, Presiding Officer observed, “after taking into consideration the entire material on record and in view of the glaring loop holes in the case, it is not possible to believe the evidence given by prosecutrix regarding her kidnapping and rape by the accused which is not only untrue but also not reliable”.
“She appears to be a consenting party in whole act and had eloped with accused possibly on account of having affair with him”, the court said, adding “the prosecution has miserably failed to bring home the guilt against the accused”.
With these observations, Court dismissed the prosecution case and acquitted the accused.
