Prosecution failure leads to acquittal of 2 alleged cheaters

JAMMU, Dec 18: Principal Sessions Judge Poonch, Jaffer Hussain Beigh has acquitted Master Abdul Qayoom  and Fareed Ahmed, who was facing trial in allegedly making Schedule Tribe and Residents of Backward Area Certificates as prosecution failed to prove the case.
According to the police case, the then Tehsildar Mendhar vide letter No. JC/93-95 dated 17.10.2003 addressed to the SHO Police Station Mendhar informed that one Kafeel Ahmed, son of Mohd Alam of Mendhar produced photostat copies of Schedule Tribe and Residents of Backward Area Certificates for attestation. On checking these certificates were found fake.
On enquiry, the beneficiary of the certificate stated that Abdul Qayoom, son of Manzoor Ahmed of Kalaban got him issued these certificates. On this, FIR No. 137/2003 for offences under Sections 420/467/468 RPC was registered and the investigation was entrusted to Rashid Ahmed Khan ASI.
During the course of investigation, Kafeel Ahmed was arrested, seizure memo was prepared, statement of witnesses under Section 161 CrPC were recorded. Later, Kafeel Ahmed was found innocent. It came to fore that Master Abdul Qayoom and Fareed Ahmed had issued forged certificates of Schedule Tribe, Backward Area. After completion of investigation challan was presented in Court.
After hearing both the sides, Principal Sessions Judge Poonch Jaffer Hussain Beigh observed, “the prosecution has failed to connect the accused Abdul Qayoom and Fareed Ahmed with the commission of the offence attributed to them”.
Accordingly, Abdul Qayoom and Fareed Ahmed were acquitted.
