JAMMU, June 21: Public Works (R&B) Department today ordered cancellation of placement of 20 Incharge Assistant Engineers (Civil) as Incharge Assistant Executive Engineers (Civil).
Vide two different Government orders, few Junior Engineers were placed as Incharge Assistant Engineers in the year 2014. However, some Junior Engineers filed representation before the department and knocked the doors of the High Court on the ground that they were senior to those who have been placed as Incharge Assistant Engineers.
The High Court passed the order for considering the claim of the petitioner and accordingly Public Works (R&B) Department found that discrepancy had occurred due to non-availability of final seniority list of JEs and non-inclusion of category certificates in favour of some reserved category candidates.
After seeking concurrence of the Law, Justice and Parliamentary Affairs Department, the Public Works (R&B) Department revoked the placement of 20 JEs. Aggrieved of the Government action, these Incharge AEs filed a writ petition wherein status quo was ordered to be maintained. Subsequently, these JEs of 2009 batch continued to work as Incharge AEs.
Thereafter, the High Court dismissed the petition and consequently these engineers filed LPA which was dismissed. In the month of May this year, the HRM Section of the department came to know about the appeal through the letter of Director Litigation and in the meantime these engineers were elevated as Incharge AEEs as they had attained seniority and eligibility by this time.
“Since the judgment of High Court in LPA is absolute, therefore the Government order of 2015 is held valid and the placement order as Incharge AEEs (Civil) issued vide Government Order No.190-PW(R&B) dated May 10, 2023 in respect of 20 engineers figuring in Government order of 2015 is hereby revoked and these engineers shall retain their original positions with immediate effect”, read an order issued by Shailendra Kumar, Principal Secretary to the Government R&B Department.
These engineers are Tahir Hussain Bhat, Muzaffar Hussain Koul, Malik Saleem Raja, Abid Ali, Arif Ahmad Banday, Abrar Ali, Mehraj-ud-Din Rather, Saba Zahoor, Adil Hussain Paul, Yuvika Wadhwa, Rafiq Hussain Pandit, Vikramjeet Singh, Shivalika, Shazia Faiz, Hilal Ahmad Wani, Malik Zada Mudasir Bashir, Nazir Ahmad Rather, Shakil Ahmed Sofi, Abdul Qadir Khan and Mohammad Saleem.
