JAMMU, Apr 24: State High Court has come to the rescue an employee, who has been denied GP fund by Director General Accounts and Treasuries on the pretext of financial crunch, and directed the officer to pay the GP fund or appear before the court in person to explain his position.
The petitioner Mangat Ram Sharma submitted before the High Court that in terms of Order No. 1192 dated March 7, 2015 sanction was accorded to the withdrawal of GP Fund in his favour but for the last more than one and a half month the same was not released on ground of financial crunch.
“Amount of GP Fund is the hard earned money and personal property of every individual employee and not a bounty, therefore, cannot be used by the Government for any other purpose”, submitted Advocate Sudershan Sharma appearing for the petitioner.
“The employees of Central Government generally get their GP Fund released on the same day they apply but the employees of State Government are being harassed to get their own amount. There are number of the employees of the State Government who are not getting their amount of GP Fund despite according of the sanction in their favour for the last so many months”, he further submitted, adding “the respondents are releasing the GP Fund only by adopting pick and choose method to favour certain class of employees”.
After hearing counsel for the petitioner, Justice Tashi Rabstan directed DG Accounts and Treasuries to pay GP fund or appear before the court in person to explain his position.
