HC quashes Govt’s passport rejection order

Srinagar, Jan 30: High Court today quashed an order of a Passport Officer Srinagar which had denied passport to brother of a Hizbul Mujahideen militant.
A Single Bench of the High Court comprising Justice Ali Mohammad Magray today directed the Inspector General of Police (CID) to submit a fresh report within two weeks about the applicant which is not influenced by the track record of his relatives.
The applicant, Umar Ali, and his wife were denied passport for being relatives of a militant. The couple approached the court seeking directions to the authorities to issue passport for them as there is nothing adverse against them in the police records.
The petitioner had pleaded that the passport is refused to them on irrational, arbitrary, unjust, unfair and unreasonable grounds, thus violating the rights guaranteed to them under the constitution.
Justice Magray said the petitioner is being punished for the alleged sins of some other person and the order and report by the passport office and CID Department is also “violative” of the principles of natural justice.
The bench said that a person cannot be deprived of their fundamental right on a mere ground that his brother is a fugitive with an observation that there is not even an iota of allegation about the conduct or activities of the petitioner.
During the course of hearing, counsel for the Regional Passport Officer had stated that having no criminal record does not entitle a person to hold a passport and that grant of passport in favour of the petitioners attracted Section 6(2) and hence the same were refused.
In response to the passport application of Umar Ali, CID had reported that in the interest of the security and integrity of the state, the case of the petitioner was send as “Not Recommended”.
CID had said that it is possible that the petitioners are in fact going abroad on a special assignment of the militant group working in J&K and if the petitioners are allowed to go abroad on Indian Passport, they may indulge in activities harmful to the security and integrity of the state and India.
The CID report further had revealed that the brother of the petitioner crossed over LoC in 1990 for arm training and returned to this side and remained hardcore/active militant of Hizb-ul-Mujahidin till 2005 and then ex-filitrated back to PoK and is still there.

AP House rejects T-Bill

HYDERABAD, Jan 30: Andhra Pradesh Assembly today rejected the Telangana Bill by voice vote, capping days of acrimonious drama and embarrassing Congress, but posing no real hurdle in the way of creation of the new State.
Dominated by Seemandhra MLAs, numbering 160 in the House with an effective strength of 279, including the Speaker and the Chief Minister, the Assembly discarded the Centre-backed AP Reorganisation Bill 2013, on which no division was taken.
Amid high drama, Speaker Nadendla Manohar put the resolution moved by Chief Minister N Kiran Kumar Reddy seeking rejection of the Bill for consideration and it was carried by voice vote.
The resolution said: “The House while rejecting the AP Reorganisation Bill, 2013, resolves to request the Honourable President of India not to recommend it for introduction in Parliament as the Bill seeks to bifurcate the State of Andhra Pradesh without any reason/basis and without arriving at a consensus, in utter disregard to the linguistic and cultural homogeneity and economic and administrative viability of both regions.
“The Bill also completely ignores the very basis of formation of State of Andhra Pradesh, the first linguistic State created in independent India,” it said.
The Bill, which seeks to create a separate State of Telangana, was referred to the legislature by the President under Article 3 of the Constitution for eliciting its views and it is not incumbent upon the Centre to go by the opinion of the legislature.
The Centre has already decided to table the Bill in Parliament in the session beginning on February 5.
“As the time given by the President for the House to debate the Bill is coming to an end today, there is a need to conclude the discussion thereon. The Bill was tabled in the House on December 16 and 86 members participated in the debate. Almost all members expressed their views in writing and they shall form part of the official record,” Manohar said.
Since the resolution moved by the Government has been approved, the Speaker said he saw no reason to take up 10 private resolutions of other members on the same subject.
He said 9,072 proposals for amendments/expression of views on the clauses of the Bill were submitted by members in writing and they too would form part of the official record.
“As agreed to in the Business Advisory Committee meeting, these records will be submitted to the President of India as the views of this House,” Manohar said.
In the Legislative Council, Chairman A Chakrapani put the Government resolution moved by Leader of the House C Ramachandraiah to vote and it was carried by voice vote.
The Chairman announced that 54 members participated in the discussion on the Bill while almost all submitted their views in writing.
1,157 amendments/expression of views were also submitted in writing on various clauses of the Bill.
Congress, however, quickly downplayed the development, saying it was on “predicted” lines and will not affect the move for creation of Telangana.
“As far as the resolution is concerned, it does not affect the Constitutional provisions under Article 3 for creation of a new State in the Indian Union…One should remember that the Bill was sent (to Andhra Pradesh Assembly) for comments and not for a vote,” AICC general secretary in-charge of Andhra Pradesh Digvijay Singh said in Delhi.
TRS President K Chandrasekhar Rao, who has been in the forefront of the Telangana movement, said Parliament has sovereign power over formation of new States and the rejection of the Bill by the State legislature would not impact creation of Telangana.
The Lok Sabha elections would be held in “two States (post division of Andhra Pradesh)”, a confident Rao said, adding the separate State would be a reality in 15 days.
Rao said he would go to Delhi tomorrow and try to meet Prime Minister Dr Manmohan Singh, UPA Chairperson Sonia Gandhi and BJP President Rajnath Singh on the issue.
Both Congress and BJP have been strong votaries of Telangana State.
Asked if his party would now merge with Congress, he said the question would come up only after the Telangana Bill is passed in Parliament.
YSR Congress, which has vehemently opposed bifurcation of Andhra Pradesh, said it would now seek President Pranab Mukherjee’s intervention to keep the State united.
Y S Jagan Mohan Reddy will soon lead a party delegation to Delhi to meet the President, TSR Congress honorary chief Y S Vijayamma said.
“We will go to polls in a United State and our party will get a decisive mandate. YSR Congress is the only party which has taken the stand to keep the State integrated while all other parties have shown ambiguity and have deceived people through their words and deeds,” she said.
While the conflicting stands taken by its legislators from Telangana and Seemandhra regions were actuated by their regional concerns in an election year, the developments over the Bill brought forth deep divisions in the Congress as it failed to keep its flock together on the issue.
Chief Minister Reddy, who was openly defiant of the Congress leadership, decided to brazen it out and even brought forth a resolution rejecting the Congress-backed legislation even though in effect it can do little to stall the creation of Telangana. (PTI)

Youth’s arrest sparks angry protest

Srinagar, Jan 30: Angry demonstrators today blocked Srinagar-Muzaffarabad highway in North Kashmir following the arrest of a local youth by police.
The protestors alleged that a youth, Nisar Ahmad Bhat of Bhat Mohalla, Palhalan in Baramulla district was arrested by police’s Special Operation’s Group (SOG) in Hyderbeigh area.
As the news spread, people took to streets, blocked the highway and shouted slogans against police and SOG.
Police fired tear-smoke cannons to disperse protesters. But the protestors retaliated by throwing stones on them.
Police sources said Bhat had been slapped Public Safety Act for pelting stones long ago, but he was absconding. “Today, after his arrest local people staged protests and when police tried to disperse them they began pelting stones on our men,” said sources.

3 bovine animals rescued, 2 smugglers held

UDHAMPUR, Jan 30: Udhampur Police today foiled an attempt of bovine smuggling and arrested two persons besides rescuing three animals.
While conducting checking at Kud on National Highway, a Police party led by SHO Kud Inspector Raghubir Singh intercepted one Mahindra vehicle bearing registration number JK14A-8056, which was on its way from Jammu to Kashmir Valley.
During thorough search, three bovine animals were found packed tightly in the said vehicle. Both the suspects, namely Shakeel Ahmed Lone of Sangam Dooru and Nassir Ahmed of Qazigund Anantnag were asked to produced proper permission for transporting these bovine animals from one district to another but they could not produced the same. Police arrested the duo and rescued the animals.
In this connection, a case FIR has been registered.

Man missing

JAMMU, Jan 30: A 55-year man has been reportedly missing since January 26 from his residence, Vasuki Vihar, Bantalab Jammu.
According to a missing report lodged with Chinore Police Post Zahoor Hussain Shah, son of Mohd Shah has been reportedly missing since January 26.

5 shops gutted

Srinagar, Jan 30: Five shops were damaged in two separate fire incidents across the Valley.
A police spokesman said four shops of Mushtaq Ahmad Sakroo son of Ghulam Rasool of Khawaja Bagh and Nazir Ahmad Ganie son of Ghulam Qadir of Dragbal were gutted completely when fire broke out in a nearby fish market in district Baramulla.
Fire broke out in the shop of Bashir Ahmad Bhat of Chittergul near Hill-top Sumo stand in district Anantnag.
He said fire tenders prevented the fire from engulfing adjacent shops.

Man loses vital documents

JAMMU, Jan 30: A man Romesh Kumar Raina son of Chaman Lal Raina has lost his purse containing important documents like PAN card, Voter card, driving license etc at Chinore.
A missing report has been lodged with Chinore police post. Any person finding the purse may return it to Raina after dialing 9419136265.

Cong MLA disrupts Kejriwal’s press conference

NEW DELHI, Jan 30:
A press conference by Delhi Chief Minister Arvind Kejriwal was today disrupted by a Congress MLA demanding appointment of a Special Investigation Team to probe the 2008 Batla House encounter.
Asif Mohammed Khan, MLA from Okhla constituency, barged into the press conference at Delhi Secretariat and started shouting slogans against AAP after Kejriwal, in reply to a question, said that Delhi Government would not form an SIT to investigate the encounter.
Earlier, Kejriwal said a court has already given its verdict in the case and government respected the judicial process.
“A court has already given its verdict in the case and we respect the court order. We are not appointing any SIT into the case,” the Delhi Chief Minister said.
Almost immediately after Kejriwal’s remark, Khan barged into the venue of the press conference and started shouting slogans. The Chief Minister’s security tried to stop Khan but he kept shouting.
Delhi Government had yesterday decided on a probe by an SIT into the 1984 anti-Sikh riots here, two days after Congress vice-president Rahul Gandhi said some of the partymen were probably involved in the violence but were punished.
Khan said he will not extend support to the AAP government in any legislative business and does not care if Congress takes disciplinary action against him.
Last year, a trial court had convicted suspected Indian Mujahideen (IM) terrorist Shahzad Ahmed in the Batla House encounter case and sentenced him to life imprisonment. (PTI)

Youth commits suicide

Srinagar, Jan 30: A 22-years-old man has committed suicide at his home in Karnah in North Kashmir.
A police spokesman said Waseem Ahmad Parray son of Mohammad Farooq of Slaiman, Karnah, consumed poison at his home.
The spokesman said he was shifted to Sub District Hospital, Karnah where he died. Police has registered a case in this regard.

SC refuses to discharge Jayalalithaa from income tax case

NEW DELHI, Jan 30:
In a setback to Tamil Nadu Chief Minister J Jayalalithaa, the Supreme Court today refused to discharge her and her associate S Sasikalaa from three cases against them for not filing income tax returns from 1991-94 and set a time limit of four months to complete the trial.
A bench headed by Justice K S Radhakrishnan dismissed the petition filed by them challenging the Madras High Court’s order which had refused to quash the proceedings against them.
Giving green signal to the trial court to proceed against them, the apex court also vacated the stay order on the trial and directed the lower court to complete the proceedings within four months.
The Income Tax department had in 1996-97 launched criminal proceedings against Jayalalithaa, Sasikalaa and Sasi Enterprises, of which both were partners, for not filing returns for the assessment years of 1991-92, 1992-93 and 1993-94.
The trial court had dismissed their discharge pleas and the Madras High Court had upheld the same in 2006.
Subsequently, special leave petitions were filed in the apex court against the judgement of the high court. (PTI)
