Jama Masjid attack: police file charge sheets against IM man
NEW DELHI, Aug 4: Delhi Police have filed two separate charge sheets against alleged Indian Mujahideen operative Zia-Ur-Rehman in September 2010 Jama Masjid terror attack case in which two Taiwanese tourists had were injured and a mild explosion had taken place in a car parked there.
In the charge sheet filed before Additional Sessions Judge Reetesh Singh in the firing case, Special Cell of Delhi Police has charged Zia-Ur-Rehman, alias Waqas, for offences punishable under sections 323 (voluntarily causing hurt), 307 (attempt to murder), 120-B (criminal conspiracy) of the IPC and under the Unlawful Activities (Prevention) Act and the Arms Act.
Waqas, a Pakistani national, has also been chargesheeted under various provisions of the Explosive Substances Act, the Unlawful Activities (Prevention) Act, Arms Act and Information Technology Act and under section 120-B (criminal conspiracy) of the IPC in the blast case.
The Special Cell of Delhi Police told the court that days before the 2010 Commonwealth Games in Delhi, two bikers had fired on tourists on September 19, 2010, at the gate of Jama Masjid in Old Delhi area and two Taiwanese, Ku-Ze-Wei and Ko-Chiange, had sustained bullet injuries whereas a bomb was fitted in a car parked in the area.
The car had caught fire after a mild blast, it said.
It also said that 25-year-old Waqas had come to India in September 2010 on the instructions of IM co-founder Riyaz Bhatkal “for assisting Ahmed Siddibappa (IM India chief Yasin Bhatkal) in the execution of terrorist attack before the Commonwealth Games.”
“From investigation conducted so far against the arrested accused persons, it is established that accused Zia-Ur-Rehman, as a member of banned terrorist organisation IM, entered into a conspiracy along with other co-conspirators for commission of terrorist act in Delhi at Jama Masjid….,” it said.
“Being a member of proscribed terrorist outfit, accused voluntarily entered into India and actively participated in the conspiracy and planning, leading to firing at foreigners in Jama Masjid and planting of IED (improved explosive device),” it said.
In its charge sheets, the police alleged that Waqas had purchased electronic items to prepare a circuit which was used in preparation of IED planted in the car.
It also said that 10 accused, including Yasin Bhatkal and his aide Assadullah Akhtar, have already been arrested in the Jama Masjid terror attack cases and charge sheets filed against them.
“All the accused persons then conspired together and decided that a terror attack would be carried out in Delhi on the occasion of anniversary of Batla House encounter i.e. on September 19, 2010.
“It was decided that foreign tourists found near the Jama Masjid, Delhi, would be shot at and a secondary bomb blast, to inflict maximum casualty on relief/rescue teams and onlookers who will reach the shooting scene, will be executed,” the police said.
It also alleged Waqas, along with Yasin Bhatkal and others, had conducted a recee of the Jama Masjid area to carry out the terror strike.
Referring to the disclosure statement of Waqas, the police said he had undergone training at Lashkar-e-Toiba (LeT) camp and Taliban’s camp in Pakistan where he was trained to handle arms and explosives.
It claimed Waqas came to India through Nepal and met Yasin Bhatkal and other IM members in Bihar and owner of the house, which was used as a hideout by accused in Darbhanga in Bihar, has also identified the photograph of Waqas.
The police said these accused used to set up a hideout in the city where they had conspired to carry out terror strike.
Waqas was arrested outside Ajmer railway station on March 22 by the special cell.
The police had earlier claimed Yasin Bhatkal was instructed by Pakistan-based handlers to carry out terror attacks just before the beginning of the 2010 Commonwealth Games (CWG) held in Delhi.
It had said the conspiracy for the attack was hatched to “dissuade foreign nations from participating in the Games and to portray the image of India, the host nation, as a weak and disturbed nation”.
The police had said that in pursuance to the conspiracy, Yasin had procured one carbine and one pistol and the initial plan was to target foreign tourists at the German Bakery at Paharganj here.
In mid 2010, accused Qateel Siddiqui, who died under mysterious circumstances in Pune Yerawada Jail in 2012, had hurt himself due to accidental firing of the carbine and the plan to strike German Bakery was aborted.
Thereafter, Yasin Bhatkal and others planned to carry out a terror strike at Jama Masjid and on September 19, 2010, IM operatives had opened fire at tourists deboarding a bus near gate number 3 of the mosque.
It had said that after the plan to carry out attack at the German Bakery in Paharganj here had failed, Pakistan-based top IM leaders sent Waqas and IM operative Tabrez for assisting Yasin in terror strike. (PTI)
