JAMMU, Sept 1: 2nd Additional Sessions Judge Jammu Rajinder Sapru has stayed the order of JMIC (Forest) Jammu whereby directions were issued for release of vehicle seized with cattle.
The stay has been granted in a revision petition filed by Society for Prevention of Cruelty to Animals through its Senior Vice-President Devender Kaur Madaan.
The JMIC (Forest) vide impugned order directed release of seized vehicle along with cattle in favour of Mohd Sharief by holding him to be the rightful person entitled to custody and possession of vehicle, which according to the revision petition was totally in violation of Transport of Animal Rules, 2009 and Care and Maintenance of Case Property Animal Rules, 2017.
After hearing the counsel for the revision petition, the 2nd Additional Sessions Judge observed, “several debatable grounds including that the Magistrate has wrongly held the respondent entitled to custody of vehicle against the Cruelty to Animals Act and Rules raised in the petition appear to have some prima-facie merit”.
Accordingly, the court issued notice to the other side for next date and in the meanwhile as an interim measure of relief stayed the order of JMIC (Forest) subject to objections from otherside.
