Non-bailable warrant against 2 cops

Srinagar, Mar 3:  A local court today issued fresh non-bailable arrest warrants against the two policemen who have been accused of killing a minor during protests in the 2010 summer unrest in the Valley after they failed to obey earlier order of the court for personal appearance.
Chief Judicial Magistrate Srinagar, Virender Singh Bhou, directed the Inspector General of Police Abdul Gani Mir to execute the order without fail.
The court observed the DPO has reported that the earlier warrants could not be executed as accused was on leave.
“The report is not satisfactory. Presence of the accused is imperatively required. Even no motion on behalf of the accused has been moved for further to attend the court on seeking execution,” the CJM observed.
Wamiq Farooq, a class VII student, was killed on January 31, 2010 when a teargas shell fired from a close range by the accused policeman hit him on the head near Gani Memorial Stadium at Rajouri Kadal in the old part of Srinagar.
Soon after Wamiq’s killing, his father, Farooq Ahmad Wani had filed a complaint before the CJM seeking registration of an FIR under Section 302 RPC.
Citing that “sufficient material of commission of offences” about the accused cops was available, the Additional District Sessions Judge, Parveez Hussain Kachroo, Srinagar had dismissed the revision petition filed by police and directed it get the accused cops before the trial court today.
“There is no illegality in CJM’s order. The cops are directed to remain present before the CJM court on next hearing,” the court had directed.
Earlier, Chief Judicial Magistrate Srinagar had issued non-bailable arrest warrants against Sub-Inspector Abdul Khaliq and SPO Mohammad Akram in connection with the killing of Wamiq Farooq.
The court had directed the Inspector General of Police, Kashmir, to execute the warrants that were issued under Section 304 RPC (culpable homicide not amounting to murder).
